Empresa deverá indenizar cobrador impedido de se agasalhar contra o frio

Um cobrador de estação-tubo de Curitiba que passava frio no trabalho por ser obrigado a usar apenas o uniforme da empresa deverá receber R$ 7 mil de indenização por danos morais. O trabalhador era proibido de acrescentar outras peças ao vestuário, sob pena de multa, mesmo que as roupas fornecidas pela Araucária Transporte Coletivo não fossem suficientes para aquecer o corpo no período de baixas temperaturas.

A decisão, da qual cabe recurso, é dos desembargadores da 6ª Turma do Tribunal Regional do Trabalho do Paraná.
Os magistrados consideraram desumana a atitude da empresa de transporte e ressaltaram que “a facilidade da solução a ser tomada para remediar a situação evidencia o caráter injustificado e, mais que isso, injustificável, da exigência imposta pela ré”. Para resolver o problema – enfatizou a 6ª Turma – bastaria a adaptação do tipo de uniforme para o clima frio da cidade e, ainda que isso gerasse custos, os riscos do empreendimento caberiam ao empregador (art. 2º da Consolidação das Leis do Trabalho).

Segundo o acórdão, o cobrador foi submetido à sensação desagradável de frio sem necessidade, além de ficar mais exposto a problemas de saúde em razão do comportamento da empregadora. Assim, ficou caracterizada “a existência de danos morais indenizáveis, diante da ilicitude da conduta culposa por parte da ré, geradora de prejuízos ao autor, que, em tal contexto, fica inegavelmente exposto a condições desfavoráveis de trabalho, capazes de gerar padecimento tanto físico quanto psíquico”.
O acórdão da 6ª Turma confirmou a condenação por danos morais imposta pela sentença de primeiro grau, reduzindo, no entanto, o valor da indenização de R$ 20 mil para R$ 7 mil.
